I. General Definitions

  • Terms of Service – this document

  • Service Provider – the company "Miętowa 18" with registered address: Miętowa 18, NIP: 547-193-01-55
  • User – any natural person accessing the Service and using the services provided through the Service by the Service Provider.
  • Electronic Communication – Communication between the parties via electronic mail (e-mail).

II. General Provisions

  • The Terms of Service define the rules for the functioning and use of the Service and determine the scope of rights and obligations of Users and the Service Provider in connection with the use of the Service.
  • The Service Provider's services consist of providing free tools in the form of the Service, enabling Users to access content in the form of posts, articles, audiovisual materials, web applications and electronic forms.
  • Any content, articles and information with the nature of tips or advice published on the Service are only a general collection of information and are not addressed to individual Users. The Service Provider is not liable for their use by Users.
  • The User assumes full responsibility for the manner of use of the materials made available through the Service, including their use in accordance with applicable law.
  • The Service Provider provides no warranty as to the usefulness of materials placed on the Service.
  • The Service Provider shall not be liable for any damages suffered by Users of the Service or third parties in connection with the use of the Service. All risk associated with using the Service, and in particular with using and utilizing information placed on the Service, is borne by the User.

III. Terms of Use

  • Use of the Service by each User is free of charge and voluntary.
  • Users are obliged to read the Terms of Service and other documents forming an integral part thereof, and must fully accept their provisions in order to continue using the Service.
  • Users may not use any personal data obtained through the Service for marketing purposes.
  • Technical requirements for using the Service:

    • any web browser that displays web pages in accordance with the standards and provisions of the W3C Consortium and supports HTML5 websites,
    • JavaScript enabled,
    • Cookies enabled
  • To ensure the security of the Service Provider, Users and other Users of the Service, all Users should follow the generally accepted principles of internet security.
  • The following actions performed personally by Users or using software are prohibited:
    • without written consent, decompiling and analyzing source code,
    • without written consent, causing excessive load on the Service server,
    • without written consent, attempting to detect vulnerabilities in the Service's security and server configuration,
    • attempting to upload or inject into the server and database code, scripts and software that could harm the Service's software, other Users or the Service Provider,
    • attempting to upload or inject into the server and database code, scripts and software that could track or steal data of Users or the Service Provider,
    • taking any actions aimed at damaging, blocking the operation of the Service or preventing the realization of the purpose for which the Service operates.
  • In the event of detecting or the potential possibility of a Cybersecurity incident or GDPR violation, Users should first report this fact to the Service Provider in order to quickly resolve the problem/threat and protect the interests of all Users of the Service.

IV. Registration Terms and Conditions

  • Users may use the Service without registration.
  • Users must be registered and have an account in the Service to use additional services available only to logged-in Users.
  • Registration in the Service is voluntary.
  • Registration in the Service is free of charge.
  • Each User may have only one account in the Service.
  • Technical requirements for account registration:
    • possession of an individual e-mail account,
  • Users registering in the Service consent to the processing of their personal data by the Service Provider to the extent that they were entered into the Service during the registration process and their subsequent modification or deletion.
  • The Service Provider has the right to suspend or delete User accounts at its own discretion, thereby preventing or limiting access to individual or all services, content, materials and resources of the Service, in particular if the User violates the Terms of Service, applicable law, rules of social coexistence or acts to the detriment of the Service Provider or other Users.
  • All services of the Service may be changed in terms of their content and scope, added or removed, and also temporarily suspended or access to them may be restricted, at the sole discretion of the Service Provider, without the possibility of Users objecting.
  • Additional security rules for account use:
    • Registered Users are prohibited from sharing their login and password with third parties.
    • The Service Provider has no right and will never demand the User's password.
  • Account deletion:
    • Every User with an account in the Service has the ability to independently delete their account from the Service.
    • Users may do so after logging into the user panel in the Service.
    • Deleting an account results in the removal of all User identification data and anonymization of the username and e-mail address.

V. Communication and Other Services

  • The Service provides contact details in the form of:
    • E-mail address
  • When a User contacts the Service Provider, Users' personal data will be processed in accordance with the "Privacy Policy", which forms an integral part of the Terms of Service.

VI. Collection of User Data

In order to properly provide services through the Service, protect the legal interests of the Service Provider and ensure compliance of the Service's operation with applicable law, the Service Provider through the Service collects and processes certain data about Users.

In order to properly provide services, the Service uses and saves certain anonymous information about the User in cookies.

The scope, purposes, manner and rules of data processing are available in the annexes to the Terms of Service: "GDPR Information Obligation" and in the "Privacy Policy", forming an integral part of the Terms of Service.

  • Automatically collected data:
    For the smooth operation of the Service and for statistics, we automatically collect some data about the User. This data includes:

    • Screen resolution
    • Approximate location
    • Subpages visited
    • Time spent on a given subpage
    • Operating system type
    • Previous page address
    • Referring page address
    • Browser language
    • Internet connection speed
    • Internet service provider

    The above data is obtained through the Google Analytics script and is anonymous.

  • Data collected during registration:
    Username, first and last name, e-mail address

    For logged-in Users (with an account in the Service), cookies stored on the User's device may contain a User identifier associated with the User's account.

VII. Copyright

  • The owner of the Service and its copyrights is the Service Provider.
  • Some data published in the Service is protected by copyrights belonging to companies, institutions and third parties, unrelated to the Service Provider in any way, and is used on the basis of obtained licenses or free licenses.
  • Pursuant to the Act of 4 February 1994 on copyright, it is prohibited to use, copy, reproduce in any form or store in search systems (excluding Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn) any articles, descriptions, photos and any other content, graphic, video or audio materials on the Service without the written consent or consent communicated via Electronic Communication of their rightful owner.
  • Pursuant to the Act of 4 February 1994 on copyright, simple press information is not protected, understood as information alone without the author's commentary and evaluation. The author understands this as the ability to use information from texts published on the Service, but not to copy all or part of articles unless stated otherwise in the specific material made available on the Service.

VIII. Changes to the Terms of Service

  • All provisions of the Terms of Service may be changed unilaterally by the Service Provider at any time without giving reasons.
  • Information about changes to the Terms of Service will be sent electronically to registered Users.
  • In case of a change to the Terms of Service, its provisions take effect immediately upon publication for Users without an account.
  • In case of a change to the Terms of Service, its provisions take effect with a 7-day transition period for Users with accounts registered before the change.
  • It is assumed that every User continuing to use the Service after a change to the Terms of Service accepts them in full.

IX. Final Provisions

  • The Service Provider will make every effort to ensure that the Service's services are offered on a continuous basis. However, it shall not be liable for interruptions caused by force majeure or unauthorized interference by Users, third parties or external automated programs.
  • The Service Provider reserves the right to change any information placed on the Service at a time of its choice, without the need to notify Users of the Service in advance.
  • The Service Provider reserves the right to temporarily, fully or partially shut down the Service for the purpose of its improvement, addition of services or maintenance, without prior notice to Users.
  • The Service Provider reserves the right to permanently shut down the Service without prior notice to Users.
  • The Service Provider reserves the right to assign, in part or in full, all of its rights and obligations related to the Service without the consent of or the possibility of objection from Users.
